A 34-year-old Batesville man, reportedly found nude behind a Southside business, with various items of women’s clothing and sex articles, is facing sex-related charges, according to Lt. Brenda Bittle with the Independence County Sheriff’s Office.
The charges stemmed from an incident around 9:30 Saturday morning while Deputy Wayne Green was on patrol in the Southside area.
Green said he was flagged down by Chris Pulley, who told him he had found the naked man behind Fireworks World, the Pulley’s family business on Newport Road.
Pulley reportedly said he found Duke L. Ashley of Neeley Street “lying naked on some cardboard behind the building with some articles lying out all around him.”
“Pulley said he told the suspect (Ashley) to get some clothes on and when he did, he put on a pair of women’s panties,” Green said.
Pulley said he saw Ashley leave the store and go to the Southside Sonic next to the Dumpster.
Green said Ashley was driving away from the Sonic as he arrived, but was able to get him pulled over at the Southside Fire Station nearby.
“Ashley was out of breath and very excited,” Green said. “I asked what he was doing behind Fireworks World naked and he said that he was just doing things to himself. I asked why he would be doing that behind a building and he said he didn’t think anyone was around.”
Ashley agreed to a search of his van and when he got out to allow the search to begin, he was not wearing any shoes or socks, according to Green.
“I could see what appeared to be pornographic magazines in a garbage bag in the back of the van,” Green said. “There was also another bag full of women’s clothes and two pillows and a blanket in the back floor.”
Bittle said that officers collected all the evidence in the incident, including summer sausages, and placed it into an evidence locker along with copies of photographs taken in the van and at the original scene.
Ashley was placed under a Criminal Investigations Division “no bond” hold at the time of his arrest.
“We’ll be filing charges today of public sexual indecency and criminal trespass,” Bittle said.
Ashley has a court date of Oct. 7 to answer to the charges.
